Terms and conditions
1. GENERAL PROVISIONS
- These Terms and Conditions define the rules for using the online store available at www.zest-world.com, including in particular the rules for placing orders and concluding distance sales contracts, delivery of Products, payments, the right of withdrawal from the contract, submission and handling of complaints, and protection of personal data.
- The owner of the Store and the seller is Zest World sp. z o.o., with its registered office in Poznań, ul. Promienista 132, 60-142 Poznań, entered into the Register of Entrepreneurs of the National Court Register under KRS number 0001140910, NIP 7792580085, REGON 540281446, hereinafter referred to as the Seller.
- Contact with the Seller is possible via e-mail at support@zest-world.com.
- The Terms and Conditions are made available free of charge on the Store’s website in a manner that allows their acquisition, reproduction and recording.
- Placing an order in the Store constitutes acceptance of these Terms and Conditions.
- The Seller conducts retail sales of clothing and accessories via the Internet within the territory of the Republic of Poland. Expansion of sales to the territory of the European Union may require an update of the Terms and Conditions.
These Terms and Conditions apply accordingly to the sale of goods at the Seller's showroom, with the exception of provisions regarding the right of withdrawal from distance contracts.
2. DEFINITIONS
- For the purposes of these Terms and Conditions, the Store means the online service available at www.zest-world.com.
- The Seller means Zest World sp. z o.o.
- The Customer or Buyer means a natural person, including a Consumer or an Entrepreneur with consumer rights, a legal person, or an organizational unit without legal personality making a purchase in the Store.
- A Consumer means a natural person performing a legal transaction with an entrepreneur that is not directly related to their business or professional activity, as well as a natural person concluding a contract directly related to their business activity where the contract does not have a professional character for that person.
- A Product means clothing and accessories available in the Store’s offer.
- An Account means an individual Customer panel in the Store created and maintained through registration.
- An Order means a declaration of intent submitted by the Customer via the Store’s shopping cart aimed at concluding a distance sales contract.
- A Sales Contract means a contract concluded between the Customer and the Seller via the Store.
- Delivery means physical delivery of the Product to the Customer by a carrier.
- Business Days mean days from Monday to Friday excluding public holidays in Poland.
- A Durable Medium means a material or tool enabling the Customer to store information in a way that allows future access, such as e-mail.
3. TECHNICAL REQUIREMENTS AND RULES FOR USING THE STORE
- To use the Store, the Customer must have a device with Internet access, an up-to-date web browser supporting cookies and JavaScript, and an active e-mail account.
- The Seller provides electronic services via the Store, including browsing Store content, creating and maintaining an Account, and placing Orders.
- The Customer is obliged to provide accurate data, refrain from providing unlawful content, use the Store in a manner that does not disrupt its operation, and use the Store’s content solely for personal use unless the Seller has given written consent otherwise.
- Technical data such as IP address and system logs may be processed for technical and statistical purposes.
- The Store uses cookies. Detailed rules are described in the Cookie Policy available on the Store’s website.
4. USER ACCOUNT
- The Customer may use the Store without creating an Account or after creating an Account.
- Creating an Account requires completing the registration form and accepting the Terms and Conditions.
- The Customer is obliged to keep login and password confidential.
- The Customer may request deletion of the Account at any time by contacting the Seller.
5. PLACING ORDERS AND CONCLUSION OF THE CONTRACT
- Information about Products presented in the Store constitutes an invitation to conclude a contract within the meaning of Article 71 of the Polish Civil Code.
- An Order is placed by adding Products to the cart, providing delivery details, selecting a payment method, and confirming the Order.
- Placing an Order constitutes an offer to conclude a Sales Contract.
- After placing an Order, the Customer receives confirmation by e-mail. The Sales Contract is concluded when the Order is accepted for processing.
- Before placing an Order, the Seller provides essential information regarding Products, prices, payment and delivery methods, the right of withdrawal, and complaint procedures.
- The Seller may refuse to process an Order in cases including lack of payment, obvious pricing errors, unavailability of Products, or suspicion of unlawful activity.
- If an Order cannot be fulfilled, the Seller informs the Customer and proposes modification, partial fulfillment, or withdrawal and refund.
6. PRICES, PROMOTIONS AND PAYMENT METHODS
- All prices are gross prices including VAT and are expressed in PLN.
- The price displayed at the time of placing an Order is binding.
- In the event of a price reduction, the Seller indicates the lowest price applicable during the 30 days prior to the reduction or, if offered for a shorter period, the lowest price since the start of offering.
- Available payment methods include bank transfer, online payments, and payment cards.
- Orders are processed after payment is credited.
- Payments may be handled by external payment operators.
7. DELIVERY
- Delivery is carried out within the territory of Poland.
- Delivery costs are included in the Product price.
- Order fulfillment usually takes 2 to 5 Business Days from payment crediting.
- Delivery is handled by courier companies, and tracking information may be provided.
8. RECEIPT OF THE SHIPMENT
- The Customer is advised to check the condition of the package upon receipt.
- In the event of visible damage, refusal of acceptance and immediate contact with the Seller are recommended.
- Failure to prepare a damage report does not deprive the Customer of complaint rights.
9. RIGHT OF WITHDRAWAL FROM THE CONTRACT
- The Consumer has the right to withdraw from the contract within 14 days from receipt of the Product.
- Withdrawal requires submission of a declaration to the Seller.
- The Consumer bears the cost of returning the Product.
- The Consumer should return the Product to the following address: ul. Krajowa 3, 62-025 Kostrzyn, PL no later than 14 days from the date of submitting the declaration of withdrawal.
- Returned Products must be intact, unused beyond necessary inspection, and with tags attached.
- The Seller refunds payments within 14 days of receiving the returned Product.
- The right of withdrawal does not apply to personalized Products or Products inseparably connected with other goods.
10. COMPLAINTS
- The Seller is liable for non-conformity of Products with the contract for 2 years from delivery.
- Complaints must be submitted by e-mail and include Customer details, Order number, description of the issue, and the Customer’s request.
- The Seller responds within 14 days.
11. MADE-TO-MEASURE AND PRODUCT MODIFICATION SERVICE
- The Store offers made-to-measure tailoring and Product modification services.
- The execution of a Personalized Product takes place only after the Customer's express acceptance of the quotation. By accepting the quotation, the Customer confirms that they have been informed of the loss of the right to withdraw from the contract in accordance with Art. 38 point 3 of the Consumer Rights Act.
- Personalized Products are not subject to the right of withdrawal and are not returnable, except in cases of non-conformity.
12. PERSONAL DATA AND COOKIES
- The controller of personal data is Zest World sp. z o.o.
- Personal data are processed for order fulfillment, account management, complaints, and marketing based on consent.
- Detailed information is provided in the Privacy Policy.
13. COPYRIGHT AND INTELLECTUAL PROPERTY
- All Store content is protected by copyright law.
- Copying or using content without written consent is prohibited.
- Use of the Store does not transfer intellectual property rights.
14. FINAL PROVISIONS
- Contracts are governed by Polish law.
- Mandatory consumer protection laws prevail over these Terms and Conditions.
- The Seller may amend the Terms and Conditions for valid reasons.
- Disputes may be resolved amicably or by a competent court.
- The Terms and Conditions enter into force on the date of publication on the Store’s website.
